Tasty Rewards Super Bowl LX Experience Sweepstakes (“Sweepstakes”)

Official Rules (the “Rules”)

 

THIS SWEEPSTAKES IS INTENDED FOR PARTICIPATION IN THE FIFTY (50) UNITED STATES AND THE DISTRICT OF COLUMBIA ONLY AND WILL BE GOVERNED BY U.S. LAW. DO NOT ENTER UNLESS YOU ARE AT LEAST 21 YEARS OF AGE AND LOCATED IN THE UNITED STATES AND A TASTY REWARDS MEMBER AT THE TIME OF ENTRY. VOID WHERE PROHIBITED BY LAW.

 

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCE OF WINNING. INTERNET ACCESS REQUIRED. BY PARTICIPATING IN THIS SWEEPSTAKES, ENTRANT AGREES TO BE BOUND BY THESE RULES AND THE DECISIONS OF SPONSOR, WHICH SHALL BE FINAL AND BINDING IN ALL RESPECTS. AN ENTRANT IS NOT A WINNER OF THE PRIZE, EVEN IF THE SWEEPSTAKES SHOULD SO INDICATE, UNLESS AND UNTIL ENTRANT’S ELIGIBILITY AND COMPLIANCE WITH THE RULES HAVE BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION AND ENTRANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT.

 

1. ELIGIBILITY: This Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia who are twenty-one (21) years of age or older with a valid US driver’s license or government issued photo ID at the time of entry. Entrant must be a Tasty Rewards Member at the time of entry. The following individuals are not eligible to enter or win a prize: employees, officers, directors, contractors, and representatives of Frito-Lay, Inc. (“Sponsor”), Genesco Sports Enterprises, Inc., Propac Agency, the NFL Entities (defined as NFL Properties LLC, National Football League, its member professional football clubs, NFL Ventures, Inc., NFL Ventures, L.P., NFL Enterprises LLC, NFL International LLC, NFL Productions LLC, and each of their respective affiliates, owners, subsidiaries, shareholders, officers, directors, agents, representatives and employees, both individually and collectively), and each of their respective parents, affiliates, subsidiaries, distributors, Web design, advertising, fulfillment, judging and promotion agencies involved in the administration, development, fulfillment and execution of this Sweepstakes (hereinafter, collectively, “Released Parties”), and the immediate families (spouse, parents, children, grandparent, siblings, and/or “step” and their respective spouses, regardless of where they reside) and individuals living in the same households (those person whether or not related who live in the same residence for at least three (3) months during the twelve-month period preceding the start date of the Sweepstakes). Void where prohibited by law. Subject to all applicable federal, state and local laws and regulations.

 

2. SWEEPSTAKES PERIOD: Sweepstakes begins 12:00 PM (noon) Central Time (“CT”) on December 28, 2025 and ends 11:59 PM CT on January 10, 2026 ("Sweepstakes Period"). (“Sweepstakes Period”). The time clock of computer administering this Sweepstakes is the official clock for this Sweepstakes.

 

3. HOW TO ENTER: During the Sweepstakes Period, an eligible Tasty Rewards entrant will be able to access the Sweepstakes through their homepage and account (“Account”) dropdown on tastyrewards.com (“Web Site”). If you are not a Tasty Rewards member, please follow the instructions on the Web Site to create a free account. By creating an account and participating in “Tasty Rewards” you agree to the Tasty Rewards terms and conditions. Upon signing into their Tasty Rewards Account an eligible entrant may collect entries by completing one or more of the activities (each an “Activity”) as indicated in their “My Activities” page. Upon completing an Activity, entrants will receive the applicable number of entries as set forth in the “My Activities” page (“Entries”). All entrants must have a valid email address. Entrants may use or bank Entries.

 

During the Sweepstakes Period, entrants may choose to use one or more of their collected Entries into the Tasty Rewards Super Bowl LX Experience Sweepstakes random prize drawing for a chance to win the prize below or bank Entries and save them to use at a later time. Entrants must submit their Entries into the Tasty Rewards Super Bowl LX Experience Sweepstakes by 11:59 PM CT on January 10, 2026 to be eligible for a chance to win the prize. There is no restriction on the number of Entries you may submit, except that you may not exceed the maximum number allocated to your Account at a given time.

 

If you do not wish to use Entries to enter this Sweepstakes drawing, Entries will remain in your Account until you choose to enter another Tasty Rewards promotion drawing or until Entries expire. Unused Entries will expire after 12 months of no activity in your Account or 12 months following the date on which you completed an Activity, earned an Entry, but did not use it for a particular drawing (any unused Entries remaining in an Account after that time will be forfeited). Entries have no cash value, may not be transferred to a third party and may not be aggregated from multiple Accounts. Unexpired Entries collected and not used for this Sweepstakes may be eligible for future Tasty Rewards drawings, in Sponsor’s sole discretion. Any Entry used in this Sweepstakes drawing will not carry over into other Tasty Rewards promotion drawings and will be void. By submitting an Entry into this Sweepstakes drawing, you confirm that you are eligible to participate according to these Rules. When logged onto your Account, you can check your Account details for Entries or Entry Point balances and details. The decisions of the Sponsor with respect to Sweepstakes entry, Account balances and transactions are final and binding and non-appealable in all respects. Proof of submission will not be deemed to be proof of receipt by Sponsor. No mechanically reproduced, altered or forged Entries are permitted.

 

Each submission must be manually key stroked and/or manually entered by the individual entrant; automated and/or repetitive electronic submission of entries (including but not limited to entries made using any script, macro, bot or sweepstakes service) will be disqualified and transmissions from these or related email addresses/IP addresses may be blocked. Additionally, use of multiple email addresses, phone numbers and/or mailing addresses, and/or the manipulation of such information, for the purpose of obtaining more than the stated number of Entry Points, Sweepstakes Entries, and/or prizes, is prohibited and such persons will be disqualified and all Entry Points or Sweepstakes Entries shall be deemed invalid and any prize won shall be forfeited, as determined in the sole discretion by the Sponsor.

 

Standard data rates may apply if the Web Site is accessed via a mobile device, and Entrants are solely responsible for any such charges.

 

4. PRIZE DRAWINGS: On or about January 12, 2026, Sponsor’s representatives, whose decisions are final and binding on all matters relating to this Sweepstakes, will randomly select the potential winner for the prize indicated below from all eligible Super Bowl LX Experience Sweepstakes Entries received during the Sweepstakes Period. Odds of winning a prize depend on the number of eligible Sweepstakes Entries received during the Sweepstakes Period for the Tasty Rewards Super Bowl LX Experience Sweepstakes.

 

5. PRIZE DETAILS: ONE (1) PRIZE: A trip for winner and winner’s one (1) guest (who must be at least 21 years of age as of February 6, 2026) to attend Super Bowl LX (“Game”) which is scheduled to take place on February 8, 2026 in Santa Clara, California. Travel dates: February 6, 2026 – February 9, 2026. Trip package includes: (a) roundtrip commercial coach air transportation from a major U.S. gateway airport near winner’s residence (as determined by Sponsor) to the host city of Super Bowl LX in California; (b) hotel accommodations for four (4) days/three (3) nights (single room, double occupancy); (c) shared-bus transportation from hotel to Game and back to hotel after the Game; (d) two (2) Game tickets; (e) two (2) tickets to attend a concert associated with Super Bowl LX (date, time, venue, seat locations determined by Sponsor); (f) two (2) commemorative gift bags; and (g) one (1) $750.00 travel stipend (awarded in the form of a check, payable to the winner). Prize Conditions apply, see below. Approximate Retail Value (“ARV”) is up to $12,050.00.

 

Special Notes for winner and guest: Must complete a release of liability form and photo, video, and likeness release form. No drug use or firearms permitted. No hateful or violent behavior.

 

Prize Conditions:The actual value of the prize may vary depending on point of departure, booking dates and fare/rate fluctuations. If the actual value of the prize is less than the stated ARV, the difference will not be awarded. All travel arrangements must be made through the Sponsor or Sponsor’s designee. Certain restrictions may apply. The dates and times of departure and return are subject to change at Sponsor’s sole and absolute discretion.

 

Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, accommodations provider, venue operators, transportation companies, prize providers or any other persons providing any prize-related services or accommodations. Sponsor reserves the right to structure travel route and select accommodations in their sole and absolute discretion. The round trip air transportation element for the prize begins and ends at the point of departure. The prize is subject to seat and accommodations availability, as well as Sponsor’s terms and conditions generally applicable thereto. If, in the judgment of Sponsor, air travel is not required due to winner’s proximity to prize location, ground transportation will be substituted for round trip air travel at Sponsor’s sole and absolute discretion. The winner of the prize must travel as and when designated by Sponsor or the prize may be forfeited and an alternate randomly selected winner chosen, if time permits. No refund or compensation will be made in the event of the cancellation or delay of any transportation or missed prize events, opportunities or expenses incurred or change to any other prize element as a consequence of delay or cancellation, except at the sole and absolute discretion of Sponsor.

 

The winner and winner’s guest must travel together and on the same itinerary and possess all required travel documents, including visas and valid passports, if and as applicable. It is the responsibility of the winner and winner’s guest to provide proper documentation (including government issued picture identification). Winner and guest are responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. The winner will be required to provide a credit card at the time of check-in at hotel. Airline tickets are non refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles.

 

Winner’s guest must execute liability/publicity releases prior to issuance of travel documents. Once the guest is selected, such person may not be substituted, except in Sponsor’s sole and absolute discretion. Travel is subject to the terms and conditions set forth in this Sweepstakes, and those set forth by Sponsor’s transportation carrier(s) of choice. Lost, stolen or damaged airline tickets, travel vouchers or certificates will not be replaced or exchanged. All expenses not specifically mentioned herein, are not included as part of any prize package, and are solely the winner’s responsibility, including, but not limited to: excursions, taxes, additional ground transportation at the winner’s destination(s), travel insurance, room service, bag check fees, parking fees, laundry service, food, alcoholic beverages, merchandise, souvenirs, telephone calls, tips, gratuities and service charges. Transportation carrier and regulations and conditions of the accommodations provider apply. Travel and lodging are subject to availability, and any changes made to either of these will be at the expense of the winner.

 

If, for whatever reason, the Game cancelled after the prize is awarded, Sponsor’s liability for the prize is limited only to the non-Game portions of the prize. No compensation will be paid in lieu of the cancelled Game. Game tickets are subject in all respect to the terms and conditions set forth on the tickets and any requirements of the facility hosting the Game. Ticket redemption may include the requirement that winner must download a mobile ticketing app (valid email address required) and present tickets for entry via a mobile device. Data rates may apply. WiFi available at most venues. Seat locations will be determined by Sponsor. The winner is strictly prohibited from selling, auctioning, trading or otherwise transferring the tickets unless Sponsor consents in writing. In the event winner (and/or companion) violates any venue or NFL policy or law, fails to comply with the NFL’s (or its designee’s) health and safety protocols, brings an of the Released Parties into disrepute, or engages in behavior that (as determined by Sponsor, the NFL Entities, or any prize provider in its or their sole and absolute discretion) is obnoxious, inappropriate, safety risk, or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to revoke the full or partial prize from any winner or guest or terminate the applicable experience early. Decisions regarding the conduct of the winner and guest in all aspects of their participation in all prize-related events will be in the sole discretion of Sponsor, and any of Sponsor’s representatives and final and binding in all respects. Winner and guest may be removed or disqualified from participating in any aspect of the prize for any reason at any time, including, without limitation, creating an unauthorized disturbance, interruption or unnecessarily rough physical contact, creating the potential for injury or property damages, or for any unhealthy, unsafe, unlawful, or inappropriate act. If winner or guest, in the opinion of Sponsor or any of Sponsor’s representatives, is considered a physical or mental threat to the well-being of any other individual, he/she may be removed from any premises relating to the prize and winner consents to such removal.

 

For the avoidance of doubt, unused tickets cannot be refunded, exchanged or applied towards tickets for any subsequent NFL event or for cash.

 

Winner and guest irrevocably waive all claims against the Released Parties, and agree that they will have no liability or responsibility for any claim arising in connection with participation in the trip prize, including but not limited to personal injury, or wrongful death, a potentially heightened risk of exposure to communicable diseases, viruses, bacteria or illnesses (including, without limitation, COVID-19) and the causes thereof, and sickness arising as a result of winner’s acceptance of prize package, related activities (e.g., travel), wherever, whenever or however the same may occur. Winner and guest must abide by all applicable federal, state, local and venue COVID-19 guidelines while traveling and in attendance at the prize event. Winner and guest will accept the prize and travel at their own risk.

 

6. LIMITATIONS OF LIABILITY AND RELEASE: No liability or responsibility is assumed by Released Parties resulting from entrant's participation in or attempt to participate in the Sweepstakes or ability or inability to upload or download any information in connection with the Sweepstakes. No responsibility or liability is assumed by the Released Parties for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Sweepstakes: Hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic or Internet connectivity or other online or network communication problems; errors or limitations of any Internet providers, servers, hosts or other providers; garbled, jumbled or faulty data transmissions; failure of any online transmissions to be sent or received; lost, late, delayed or intercepted transmissions; inaccessibility of the Web Site in whole or in part for any reason; traffic congestion on the Internet or Web Site; unauthorized human or non-human intervention of the operation of the Sweepstakes, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, or worms; or destruction of any aspect of the Sweepstakes, or loss, miscount, misdirection, inaccessibility or unavailability of an email account used in connection with the Sweepstakes. Sponsor is not responsible for any typographical errors in the announcement of prizes or these Rules, or any inaccurate or incorrect data contained on the Web Site. Use of Web Site is at user’s own risk. None of the Released Parties are responsible for any personal injury or property damage or losses of any kind which may be sustained to user's or any other person's computer equipment resulting from participation in the Sweepstakes. In the event of an identity dispute, Entry will be considered made by the registered owner of the email address associated with the account used for Entry. “Registered owner” is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or other organization which is responsible for assigning email addresses or the domain associated with the submitted email address. The entrants and winner acknowledge that the Released Parties are not responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Any and all warranties and/or guarantees on a prize (if any) are subject to the respective manufacturers’ terms therefore, and winner agrees to look solely to such manufacturers for any such warranty and/or guarantee. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL, CONSEQUENTIAL, OR OTHER DAMAGES; AS A RESULT, THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU, AND THE FOREGOING PARAGRAPHS SHALL NOT APPLY TO A RESIDENT OF NEW JERSEY TO THE EXTENT DAMAGES TO SUCH NEW JERSEY RESIDENT ARE THE RESULT OF SPONSOR OR ANY OF THE OTHER RELEASED PARTIES’ NEGLIGENT, FRAUDULENT OR RECKLESS ACT(S) OR INTENTIONAL MISCONDUCT.

 

7. WINNER NOTIFICATION: The potential winner will be contacted by Sponsor’s representative via email and will be required to follow instructions within the notification within forty-eight (48) hours (beginning at the time the notification was sent), or prize may be forfeited, in Sponsor’s sole discretion. If no return message is received within the time allotted, an alternate winner will be selected, time permitting. Any alternate winner selected will also be required to respond to the prize winning message within forty-eight (48) hours. The potential winner will be required to complete, sign and return an Affidavit of Eligibility/Liability Release, and, where lawful, Publicity Release within two (2) days of prize notification. Prize winner’s guest must complete and return a Liability/Travel Release within the same time period. Failure to return the above-stated documents from both winner and their guest, within the specified time period may result in prize forfeiture, in Sponsor’s sole discretion, and an alternate Prize winner may be selected.

 

Sponsor will attempt to notify the potential winner as set forth above, but Sponsor is not responsible for any change in entrant's email address, mailing address and/or telephone number. If attempted notification is returned as undeliverable (including without limitation e-mails that are not received because of a winner’s privacy or spam filter settings which may divert any Sweepstakes e-mail, including any winner notification e-mail, to a spam or junk folder), if any required documents are not returned within the required number of days, if winner cannot be verified, if winner is found to be ineligible by civil or criminal or social media information review, as determined by Sponsor in its sole discretion, if winner is determined to be ineligible or otherwise not in compliance with these Official Rules, or if winner is otherwise unable to accept the prize as stated, prize may be forfeited. If a prize is returned as undeliverable, the prize may be forfeited and Sponsor shall have no further liability to award that prize.

 

If an insufficient number of qualified Entries are received, prize may not be awarded.

 

8. RELEASE OF LIABILITY: BY PARTICIPATING IN THIS SWEEPSTAKES, EACH ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE SWEEPSTAKES, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY THROUGH BINDING ARBITRATION AS SET FORTH ABOVE, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS, AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY), BUT IN NO EVENT WILL ATTORNEYS' FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES, AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) ENTRANT'S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO EVERY ENTRANT. By accepting a prize, recipients (a) agree that Released Parties will have no liability whatsoever for, and shall be held harmless by winner against, any liability for injuries, losses or damages of any kind to persons or property resulting in whole or in part, directly or indirectly, from participation in the Sweepstakes; from acceptance, possession, misuse or use of any prize, including travel thereto and (b) grant (and agree to confirm grant in writing promptly upon request) to Sponsor and the NFL Entities and their respective designees and assigns the right to use winner’s name, photograph, likeness, voice, image, statements, biographical information, and video of their prize participation (which may be altered, changed, edited, used alone or with other works, as solely determined by Sponsor) at any time or times, for advertising, trade, publicity and promotional purposes in any media now known or hereafter discovered, worldwide, including the Internet without review, notification or approval, and additional compensation or consideration, unless prohibited by law. Released Parties are not liable in the event that any portion of the Sweepstakes (including any prize) is canceled due to pandemics or epidemics, outbreaks of infectious disease or any other public health crisis including quarantine measures of any government authority or other restrictions, weather, fire, strike, acts of war or terrorism, or any other condition beyond their control (a “Force Majeure Event”).

 

9. GENERAL CONDITIONS/DISPUTE RESOLUTION: LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AND/OR THE RELEASED PARTIES RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW INCLUDING CRIMINAL PROSECUTION. Winner is solely responsible for any and all federal, state and/or local taxes, and for any other fees or costs associated with the prize they receive, regardless of whether it, in whole or in part, are used and will receive an IRS Form 1099. No substitution of prize is offered, except at the sole discretion of the Sponsor. No transfer of prize is permitted. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prize with another prize of equal or greater value, in accordance with these Official Rules. Unclaimed prizes will not be awarded. If for any reason the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Sponsor reserves the right, at its sole discretion, to (a) disqualify any individual who is responsible or who tampers with the Entry process, and (b) cancel, terminate, suspend, postpone, delay or modify the Sweepstakes in whole or in part, including without limitation, any means of Entry or redemption, at any time, including but not limited to, any occurrences described in Section 6 and 8 above, or any other causes which may corrupt or impair the integrity, security, fairness or proper conduct of the Sweepstakes, or if Sponsor determines that more prize claims are submitted and/or more prize notices are distributed than the number of prizes offered in these Rules. In such event, Sponsor shall immediately suspend all drawings and prize awards, and Sponsor reserves the right to randomly award any remaining prizes (up to the total set forth in these Rules) in a manner deemed fair and equitable by Sponsor, such as by way of example and not by way of limitation, in a random drawing from among the eligible Entries received up to the time of the impairment, and the Released Parties shall not have any further liability to any entrant in connection with the Sweepstakes. Sponsor may modify and amend these Rules as they appear online from time to time during the Sweepstakes for clarification purposes without materially affecting the terms and conditions of the Sweepstakes. The parties waive all rights to trial in any action or proceeding instituted in connection with these Rules, including, without limitation, the Sweepstakes. Any controversy or claim arising out of or relating to the Sweepstakes shall be settled by binding arbitration in a location determined by the arbitrator as set forth herein (provided that such location is reasonably convenient for claimant), or at such other location as may be mutually agreed upon by the parties, in accordance with the procedural rules for commercial disputes set forth in the Comprehensive Arbitration Rules and Procedures of JAMS (“JAMS Rules and Procedures”) then prevailing, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitrator shall be selected pursuant to the JAMS Rules and Procedures. The arbitrator shall apply Texas law consistent with the Federal Arbitration Act and applicable statutes of limitations and shall honor claims of privilege recognized at law. In the event that the claimant is able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Sponsor will pay as much of the claimant’s filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost prohibitive. If any part of this arbitration provision is deemed to be invalid, unenforceable, or illegal (other than that claim will not be arbitrated on a class or representative basis), or otherwise conflicts with the rules and procedures established by JAMS. If, however, the portion that is deemed invalid, unenforceable, or illegal is that claims will not be arbitrated on a class or representative basis, then the entirety of this arbitration provision shall be null and void, and neither claimant nor Sponsor shall be entitled to arbitrate their dispute. Upon filing a demand for arbitration, all parties to such arbitration shall have the right of discovery, which discovery shall be completed within sixty days after the demand for arbitration is made, unless further extended by mutual agreement of the parties. THE ARBITRATION OF DISPUTES PURSUANT TO THIS PARAGRAPH SHALL BE IN THE ENTRANT’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN THE CLAIMS OF OTHER PERSONS OR PARTIES WHO MAY BE SIMILARLY SITUATED. DO NOT ENTER THIS SWEEPSTAKES IF YOU DO NOT AGREE TO HAVE ANY CLAIM OR CONTROVERSY ARBITRATED IN ACCORDANCE WITH THESE OFFICIAL RULES. For purposes of the Sweepstakes, an entrant’s residential address and e-mail address will be the physical address and e-mail address submitted at the time of Entry. Entrants will not be allowed to change their physical address or e-mail address. If it is discovered or suspected that an entrant has registered or attempted to register for the Sweepstakes using multiple e mail addresses or multiple identities, all of that entrant’s Entries (as defined above) or Sweepstakes entries associated with that household (determined by Sponsor and/or its administrator in its sole discretion) may be disqualified and any prize an entrant might have been entitled to win will not be awarded any may be revoked. Use of any automated system or any like methods to participate in the Sweepstakes is prohibited and will result in disqualification of any entrant attempting such use.

 

10. ENTRY INFORMATION AND SWEEPSTAKES COMMUNICATIONS: As a condition of entering the Sweepstakes, each entrant gives consent for Sponsor to obtain and deliver his or her name, address and other information to third parties for the purpose of administering this Sweepstakes and to comply with applicable laws, regulations and rules. Any information entrant provides to Sponsor may be used to communicate with entrant in relation to this Sweepstakes or on a Sweepstakes Winner’s list. Please see Sponsor’s privacy policy located at https://contact.pepsico.com/fritolay/privacy-policy for details of Sponsor’s policy regarding the personal information collected in connection with this Sweepstakes. In the event of any discrepancy between the Sponsor’s Privacy Policy and these Rules, these Rules shall control and govern. Additionally, any communication between entrant and Sponsor or its agencies regarding this Sweepstakes (e.g., phone calls, text messages, chats, emails, etc.) may be recorded for quality assurance and training purposes.
